The 21st Century Cures Act requires states to have an electronic visit verification (EVV) system in place for personal care services beginning in 2021, and home healthcare services beginning in 2023. As of March 2021, 29 states were compliant with the mandate and 22 states were out of compliance. Though several states had EVV systems in place before the Cures Act became law, most states implemented or are working to implement systems in response to the Act’s mandate. The threat of financial penalties, coupled with the aggressive timeline for statewide implementation, led many states to focus on Cures Act compliance as the primary goal for their EVV development. As more states continue to become compliant with the mandate, attention can now shift towards the improvement of EVV systems and their role in the overall home and community-based services (HCBS) delivery system.
