On May 8, NASDDDS, NAMD, and ADvancing States jointly hosted a webinar and conference call with the Department of Labor to discuss the Fair Labor Standards Act (FLSA) Home Care Final Rule and to provide guidance on shared living arrangements. The rule expands the types of home care services subject to FLSA standards, and will impact many programs where workers provide personal care to seniors and persons with disabilities. The rule will specifically impact certain arrangements where an individual lives with a provider of care. During the presentation, DOL provided an overview of the changes within the rule, as well as information about how the rule would apply to shared living arrangements. The rule is scheduled to take effect on January 1, 2015.
