On Monday, April 26th, ADvancing States submitted comments on the discussion draft of the HCBS Access Act. If enacted, the Act would significantly transform the Medicaid LTSS system by establishing a mandatory HCBS benefits with federally-determined functional eligibility standards and extensive service package. ADvancing States agrees with the overarching goals of this legislation, to transform Medicaid and provide services in the community that enhance the quality of life of participants while reducing the reliance on institutional services, but also has some specific concerns and questions about the legislation.
