Implementing Community Integration: A Review of State Olmstead Plans

This Working Paper explores key policy issues arising from the United States Supreme Court’s decision in Olmstead v. L.C. Specifically, this paper examines how states have responded to the Court’s suggestion regarding the development of comprehensive, effectively working plans for placing qualified persons with disabilities in less restrictive settings as a way of satisfying the ADA’s “reasonable modifications” requirement.

Community Transition: The Role of Individual Assessment

This paper was developed to consider possible approaches to interpreting the concept of individual assessments as provided in the Olmstead Decision. While the process of carrying out an assessment raises basic issues that are integral to a public determination of whether an individual qualifies for a good, benefit, or status, there appear to be two types of assessments that states need to consider. This paper identifies the two classes of assessments issues for consideration in both cases.

2003 State Long Term Care: Recent Developments and Policy Directions

This report provides a thumbnail sketch of long-term care budgets, legislation and planning in the 50 states and the District of Columbia. The goal of the project is to obtain insights into recent state long-term care public policy reforms,as evidenced by their proposed or recently enacted legislation, task forces and budgets.

Medicaid Long Term Care Expenditures, FY2000

The data presented in Tables A through N are derived from HCFA 64 reports submitted by states to the Health Care Financing Administration. The HCFA 64 is the form used by states to claim Federal Financial Participation (FFP) for state Medicaid outlays, and is audited by the Federal government. It is thus considered to be one of the most reliable sources of information on state Medicaid spending.

Medicaid HCBS Waiver Expenditures, FY1995-2000

The accompanying tables and graphs present data on Medicaid expenditures for 1915(c) Home and Community-Based Services waivers from FY 1995 through FY 2000. The memo provides detailed data on expenditures for individual waivers. In addition, the materials classify each 1915(c) waiver by target population, and present information on the distribution of expenditures for HCBS services across long term care populations.
