State Medicaid Home & Community-Based Services (HCBS) Programs Respond to COVID-19: Early Findings from a 50-State Survey

This issue brief presents early findings from the most recent KFF 50-state survey of Medicaid HCBS programs, focusing on state policies adopted in response to the pandemic, the pandemic’s impact on Medicaid HCBS enrollees and providers, and states’ early plans for the new American Rescue Plan Act (ARPA) 10 percentage point temporary increase in federal Medicaid matching funds for HCBS.

CMS Offering Free HCBS Technical Assistance

CMS, in collaboration with New Editions Consulting Inc. is offering free HCBS technical assistance to states who are: planning on expanding Medicaid home and community-based services, and/or changing approaches and strategies to be more responsive to CMS guidance, stakeholder input, and state priorities, and/or modifying current HCBS programs based on state and stakeholder experiences in response to the COVID-19 Public Health Emergency.

The report highlights characteristics of the 10 states and compares their change in LTSS system balancing with other states and provides a national overview on LTSS system balancing. State profiles consist of characteristics and strategies states utilized in their progress towards rebalancing their LTSS systems.

Heightened Scrutiny Review of Newly Constructed Presumptively Institutional Settings

CMS released an informational bulletin that provides guidance regarding new constructions and the HCBS heightened scrutiny process. The 2014 Medicaid HCBS regulation’s settings regulation requires an in-depth assessment, called heightened scrutiny, for certain providers that are presumed to be institutional. This guidance provides clarification and flexibility to states, including an overview of three potential scenarios for how newly constructed settings could receive Federal funding

Electronic Visit Verification: Implications for States, Providers, and Medicaid Participants

This report describes key considerations and policy decisions that states should consider as they work to implement EVV systems in accordance with the mandate included in the 21st Century Cures Act. The paper also examines different approaches that states may wish to use to establish EVV within their HCBS programs, and discusses some of the benefits and challenges associated with each approach. Lastly, it includes case studies of four states with existing EVV systems.

Medicaid Assisted Living Services: Improved Federal Oversight of Beneficiary Health and Welfare Is Needed

This report examines state and federal oversight of assisted living services in Medicaid. Individuals receiving long-term care services from Medicaid in community residential settings is expected to grow. This report describes state spending on and coverage of these services; describes how state Medicaid agencies oversee the health and welfare of beneficiaries in these settings; and examines the extent that CMS oversees state Medicaid agency monitoring of assisted living services.
