Prior Authorization in Health Insurance: A Needed Tool to Contain Costs or an Excessive Barrier to Needed Care?

Final Rule Issued on Classifying Employees and Independent Contractors Under the Fair Standards Labor Act (FLSA)

The U.S. Department of Labor (DOL) issued a final rule revising previous guidance on how to determine whether a worker is an employee or independent contractor under the Fair Labor Standards Act (FLSA). The rule will take effect March 11. Determinations about who is an employee or independent contractor can have a big impact on direct care workers, and this revision will help to protect employees’ rights and ensure they benefit from protections under federal labor laws. On February 21, Justice in Aging released an updated and expanded version of its “20 Common Nursing Home Problems–and How to Resolve Them” issue brief, which was written with financial support from the Commonwealth Fund. This revision, like the original edition, introduces each common problem by identifying a false statement commonly made by nursing home staff, along with a clear statement of the relevant law. This updated edition addresses additional problems, discusses issues in more detail, and includes recent revisions to federal regulations and guidance. This guide gives residents, family members, friends, and other advocates the tools they need to identify and solve the problems residents most frequently face.

KFF released an updated version of their "Medicaid Enrollment and Unwinding Tracker" on May 10. This tracker provides state-level data on Medicaid/CHIP enrollment, unwinding, renewals, and other measures. Please note that while the tool includes national data reported by CMS, it has a lag of several months and may not reflect the most current Medicaid enrollment status.
