Olmstead

In this report to the Georgia Department of Community Health, Geogia reports on their nursing home transition process. The report provides an overview of the Olmstead decision, and a description of the survey used determine which individuals might be interested in transitioning from institutions. The report discusses the two grants currently underway in the state and provides recommendations for future directions.

The Texas Promoting Independence Plan is the comprehensive, effectively working plan called for as a response to the U.S. Supreme Court Olmstead decision. The Plan includes all long-term care services and supports and the state’s efforts to improve the provision of community-based alternatives. The goal is to ensure that these programs effectively foster independence and acceptance of people with disabilities and provide opportunities for people to live productive lives in their communities.

Materials available on this website provide the latest information around states’ efforts to remove employment barriers and develop a comprehensive health system for people with disabilities who wish to work.

A presentation overview of Public Housing Authorities and accessing Reasonable Accommodations and Modifications. PHAs administer 3.2 million government subsidized housing resources for low income households and people with disabilities must have an equal opportunity to participate in PHA programs. Presented at the Midwest Regional Housing Forum by Ann O'Hara.

This paper lays the groundwork for understanding the implications of the historic U.S. Supreme Court Decision in the case of Olmstead vs. L.C., which has far-reaching consequences for persons with disabilities. The paper reviews the critical components influencing the case. Also, the paper describes the federal and state responses to the ruling and concludes with a brief discussion of some legal issues that will be debated in the courts.

In Sept. ‘03 the Community Living Exchange Collaborative brought together 6 states for a Midwestern Regional Housing Forum. The presentation provides an overview and goals of the two-day forum. The notes provide an overview of the purpose and identify objectives of the Forum and highlight the specific action steps identified by the six participating state teams.

In this report, the National Conference of State Legislatures (NCSL) traces the budget issues that states confronted in 2002 and examines how they addressed those issues. The report also describes long-term care legislation enacted in 2002 and long-term care planning work that is under way in many states.

The National Council on Disability (NCD) assesses the nation's response to the United States Supreme Court's decision in Olmstead v. L.C., 527 U.S. 581 (1999) that the unjustified institutionalization of people with disabilities is a form of discrimination.
