This guide is designed to provide elder law attorneys with a better understanding of the HCBS Settings Rule and how they can advocate for a strong, effective system that achieves the spirit and intent of the rule. The guide includes an overview of the rule, a process for states to comply with the HCBS Rule, opportunities for advocacy to promote your clients' best interests, and a review of special issues including dementia care and evictions.

This report provides information about Medicaid LTSS beneficiaries in 2013. The report estimates that approximately 5.2 million people received Medicaid-funded long-term services and supports (LTSS) during calendar year 2013. This data includes state-reported estimates for managed LTSS programs. 72 percent of LTSS beneficiaries received home and community-based services (HCBS), including people who received institutional services during the year.

The Genworth Cost of Care Survey is a tool that details the costs of different types of care in various locations. This is a tool that can assist with long term care planning, and help individuals and families plan for long term care expenses. The 2017 survey covered 440 regions across the United States.

This paper describes strategies used in four highly ranked or significantly improved states, including Minnesota, to reduce the risk of long-term nursing home care after a hospitalization. Included in the paper is a toolkit of resources that can help others learn more and potentially replicate these practices, as well as contact information for experts.
