ACL's Older Americans Month 2021

ACL has announced that the theme of Older Americans Month (OAM) 2021 is Communities of Strength. Older adults have built resilience and strength over their lives through successes, failures, joys, and difficulties. Their stories and contributions help to support and inspire others. In May, ACL will celebrate the strength of older adults and the Aging Network, with special emphasis on the power of connection and engagement in building strong communities.

LTSS Choices: A Series on Transforming Long-Term Services & Supports

The AARP Public Policy Institute recently launched a three-year initiative which aims to transform long term care in the United States. LTSS Choices will be a series of reports, blogs, videos, podcasts, and virtual convenings that seek to catalyze reform and spark ideas to modernize LTSS, long term services and supports. The goal is a long-term care system that provides a wide range of choices to meet the dynamic needs and preferences of consumers and their families.

Changes to Modified Adjusted Gross Income (MAGI)-based Income Methodologies

The Centers for Medicare & Medicaid Services issued a State Health Official letter that provides guidance on legislative changes to the modified adjusted gross income (MAGI)-based methodologies used for determining Medicaid and CHIP eligibility. In order to implement the changes to MAGI-based methods, states may need to update eligibility policies and procedures and make changes to eligibility systems logic.

CMCS Informational Bulletin: Additional EVV Guidance

CMS released a bulletin addressing frequently asked questions regarding Electronic Visit Verification (EVV) requirements to beneficiaries receiving in-home care. This bulletin responds to questions surrounding beneficiaries with live-in caregivers, services delivered partially in the beneficiary's home, the provision of medical supplies, equipment, and appliances as a component of the Medicaid home health benefit, and the use of web-based timesheets as an EVV method.

Heightened Scrutiny Review of Newly Constructed Presumptively Institutional Settings

CMS released an informational bulletin that provides guidance regarding new constructions and the HCBS heightened scrutiny process. The 2014 Medicaid HCBS regulation’s settings regulation requires an in-depth assessment, called heightened scrutiny, for certain providers that are presumed to be institutional. This guidance provides clarification and flexibility to states, including an overview of three potential scenarios for how newly constructed settings could receive Federal funding

Expanding Implementation of Universal Design and Visitability Features in the Housing Stock

AARP has released an update from their Public Policy Livable Communities division, which explains that communities need to encourage more accessible homes for older adults and their families by requiring that single family homes meet visitability requirements with features such as having an entrance without steps, kitchen counters set at multiple heights, and half-bathrooms at the ground level.

National Institute on Disability, Independent Living, and Rehabilitation Research

On Wednesday, May 11, the Administration for Community Living (ACL) published a final rule that implements the Workforce Innovation and Opportunity Act (WIOA) of 2014 transfer of the National Institute on Disability, Independent Living, and Rehabilitation Research (NIDILRR) from the Department of Education to the Department of Health and Human Services (HHS). The final regulations will remain in effect until Friday, July 1, 2016.

CMCS Informational Bulletin: Medicaid Administrative Funding Availability for Long Term Care Ombudsman Program Expenditures

This bulletin reviews policy when Medicaid funding is available for certain administrative costs related to activities conducted by state Long Term Care Ombudsman (LTCO) programs that benefit the state's Medicaid program. It also summarizes the basic requirements for Medicaid administrative claiming of LTCO program activities and provides a link where states and LTCO programs can find more information regarding specific program activities that may be eligible for Medicaid administrative funding.
