State Medicaid Home & Community-Based Services (HCBS) Programs Respond to COVID-19: Early Findings from a 50-State Survey

This issue brief presents early findings from the most recent KFF 50-state survey of Medicaid HCBS programs, focusing on state policies adopted in response to the pandemic, the pandemic’s impact on Medicaid HCBS enrollees and providers, and states’ early plans for the new American Rescue Plan Act (ARPA) 10 percentage point temporary increase in federal Medicaid matching funds for HCBS.

State Health Official Letter - Updated Guidance Related to Planning for the Resumption of Normal State Medicaid, Children’s Health Insurance Program (CHIP), and Basic Health Program (BHP) Operations Upon Conclusion of the COVID-19 Public Health Emergency

CMS released a SHO letter with updated guidance to assist states in planning for resuming normal state Medicaid, CHIP, and BHP operations for the eventual end of the public health emergency. The SHO provides updated guidance regarding the extended timeframe for states to complete pending work in eligibility and enrollment to up to 12 months after the PHE ends and redetermination of eligibility requirements states must complete after the PHE for all beneficiaries before taking adverse actions.

CMS Releases Proposed Provider Reassignment Regulation

On August 3, 2021 CMS published a proposed rule that would rescind a 2019 policy change prohibiting reassignment of certain Medicaid payments. The rule would re-instate a policy that was first established in 2014 allowing payments to third parties when Medicaid program is the primary source of revenue for the provider. CMS is accepting comment on the proposed rule until September 28, 2021.

States Use Appendix K and Emergency Waivers to Support HCBS Services in Response to COVID-19

NASHP has published an Appendix K interactive map, supported by The John A. Hartford Foundation, to track each state’s new flexibilities in modified 1915 (c) and 1115 waivers. States are using these waivers and amendments to ensure that their older adults and family caregivers are receiveing the LTSS services they need during the pandemic.

Medicaid and CHIP Quality Report to Congress

On Tuesday, July 6, 2021, CMS released the Quality Report to Congress identifying efforts undertaken to improve the quality of health care for children and adults enrolled in Medicaid and the Children’s Health Insurance Program (CHIP). The report provides information on activities undertaken between 2017 and 2019, including changes in performance in the quality measures included in the Medicaid and CHIP Child and Adult Core Sets.

Better Care Better Jobs Act Introduced in the Senate

On June 24, 2021, the Better Care Better Jobs Act, S. 2210, was introduced in the United States Senate and referred to the U.S. Senate Committee on Finance. The bill would expand access to home and community-based services (HCBS) by providing $100 M for states to expand access to Medicaid HCBS and strengthen the HCBS workforce, and provide states a 10% increase in the Medicaid Federal Medical Assistance Percentage (FMAP) for HCBS.
